K1 Fiancee Visa Advantages

One question I am asked regularly is – Can my fiancee come by way of a tourist visa and marry me? The case is that a necessary requirement for a tourist visa is your fiancés sworn pledge that they basically plan to visit the U.S., not immigrate here.  If your fiancee enters the U.S. as a tourist, without disclosing that they are your fiance and also intend to marry you, they have committed visa fraud. If the USCIS after decides that this is the case, he or she may be quarantined (i.e., deported) along with that, it will be virtually impossible for them to return, even though they are married to you.

A U.S. Immigration Inspector at the port of entry might deny you entry if they believes that you are not acceptable to be granted in the range for which the visa is issued.
Although the provisions quickly affecting K1 visa are pretty sweeping, my own feeling is that the majority of K-1 visa sponsors are not going to be affected, as they will not have any criminal past that will need to be reported.  IMBRA places rules on K-1 petitions that a sponsor must follow.

One practical way a couple can find out if they want to enter into a cross-cultural marriage is for either partner to seek a K1 fiancee visa.  A period of time in your partner’s country will allow you the space to really get to know your partner and their culture and will provide sufficient information for you to choose whether you want to marry your partner.
